TERMS AND CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS FOR REGISTERING WITH THE POPCORN REWARDS PROGRAM MOBILE APPLICATION CAREFULLY. BY REGISTERING WITH THIS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE, INCLUDING OUR PRIVACY POLICY AND THE APP TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL OR ANY OF THESE TERMS, YOU WILL BE DEEMED TO NOT PARTICIPATE IN THIS PROGRAM.
The “POPCORN Loyalty Program” (hereinafter referred to as “Popcorn” or the “App”) is offered by Pharmacie Nouvelle Limited (hereinafter referred to “PNL”, “we”, “our” or “us”) for the purposes of recognizing and rewarding our loyal customers.
PNL is a company registered in Mauritius as Pharmacie Nouvelle Ltd, Plots 9 and 10, Business and Industrial Park Off Motorway M2, Jinfei, Riche Terre.
These Terms and Conditions set out the contractual relationship between PNL and each registered Popcorn user (hereinafter referred to as “Members”, “you”, “your” ) in respect of the Program.
Additional terms and conditions may apply in relation to specific offers, products and services, and will be set out on the Website or will be communicated to you via email or SMS.
About Popcorn Loyalty Program
The Popcorn Loyalty Program awards Popcorns (hereinafter referred to as “Points”) to Members when they scan their supermarket/ shop tickets which contain Popcorn registered brands or in scanning a QR code during a brand activation or winning a game on the App or in participating to a survey on the App. Said activities would qualify Members to earn Points.
By signing up to the App and opening a Membership account, you are eligible to receive Points and redeem said Points through a cashback system onto your registered local 5bank account and you agree that:
- you have read and accepted these Terms and Conditions, and you have also read and accepted the Website terms of use which are incorporated by reference herein; and
- you consent to the collection, use of your personal data by PNL in accordance with the Privacy Policy.
Members may check on the App or visit the website https://www.popcorn.mu for a complete list of registered brands as well as complete information on how you can earn Points. The list of the Popcorn registered brands may be subject to change at any time, without prior notice.
Membership in the Program is free. You must successfully complete the registration process in order to benefit from the advantages of the Program. Upon registration, you are assigned a digital membership number, accessible through the App.
1. Definitions
In these Terms and Conditions unless the context requires otherwise, the following words, terms or expressions have the meanings assigned to them hereunder:
“Affiliate” means, with respect to any person, any person directly or indirectly controlling, controlled by or under the common control of such person and for the purposes of this definition.
“App” refers to the Popcorn Loyalty Program mobile application available for Apple and Android operating systems, downloadable from App Store for Apple or from Google Play Store and Huawei App Gallery for Android.
“Brands” means registered brands participating in the Program, from which Members are eligible to earn Points.
“Valid supermarket receipts” means a supermarket receipt from a Mauritius Revenue Authority registered point of sales based in Mauritius, with a clear BRN number, address and phone number, where all items are readable.
"Fraud" means any conduct which is fraudulent, dishonest and deceitful. Such conduct includes, but is not limited to any of the following:
- knowingly supplying incorrect information to accrue Points.
- attempting to accrue Points or rewards from multiple scanning of the same receipt.
- selling, bartering and/or purchasing Points including attempting to sell or transfer Points by means of internet-based sales or auction, otherwise than as may be permitted under these Terms and Conditions.
- attempting to redeem Points obtain dishonestly.
- knowingly benefiting from the Fraud or Misconduct of another Member or individual, or
- using the APP by scanning the receipts of a corporate, wholesaler, distributor or any other entity other than individuals carrying out domestic and/or household purchases.
"Member" means the person who is a member of the Program and whose name is registered against a Membership Number.
"Membership" means membership of the Program.
"Membership Number" means the Membership number allocated to a Member in accordance with these Terms and Conditions.
"Member Data" means the personal data of a Member that collected when registering for the Program for purposes of administering the Program.
"Misconduct" includes:
- failure to comply with these Terms and Conditions.
- the conduct of any immoral or illegal acts whilst using the App.
- providing Member data, which is untrue, inaccurate, not current or incomplete, or
- use of threatening and/or violent language when dealing with employees of PNL.
“Program” means the Popcorn Loyalty Program operated by PNL pursuant to which Members earn Points.
“Reward” means any special benefit offered in addition to points earned after ticket scanning, including but not limited to cashback.
"Website" means the online pages applicable to the Program available at www.popcorn.mu or such other domain name as made available from time to time.
2. Membership of the Program
2.1 - Membership Eligibility
2.1.1 - Only individuals who:
- are 18 years of age or older;
- habitually reside in Mauritius, and
- hold a valid National Identity Card ("NIC") or Residence Permit ("RP") for Mauritius,
may apply for Membership.
2.1.2 - Membership is offered at our discretion, and we may refuse Membership to any applicant without assigning any reason.
2.2 - Membership Application
This information will be stored in the Popcorn system. Upon completion of enrolment, the applicant will be able to start earning points. The applicant will receive an SMS to confirming his/her enrolment, and a One-Time Password (“OTP”). The applicant will have 72 hours to complete the full enrolment process (see clauses 2.2.2 to 2.2.7 below) and will need this OTP to finalise his/her registration. Failure to do so will result in the automatic deletion of the applicant's Popcorn account, personal data, and accumulated points.
2.2.2 - Full Enrolment
An individual may apply for Membership by joining the Program through the App or on the Website. All applications are made via a digital form, with no hardcopy application form required. Applications may be made at any time through the App.
2.2.3 - Membership applications must state the applicant's title, first name, and family name as stated on the NIC or RP, the NIC or RP number, the date of birth, the city of residence, an email address and the Mauritian mobile number for correspondence (collectively referred to as “Registration Information”). Each NIC/RP, email address, and mobile number must be unique in our system, hence only one Account can be registered per NIC / RP number, email address, and/or mobile number. To verify the accuracy of the information, the applicant will receive an OTP on his/her phone, which will be used to finalise their enrolment and an email with a link to confirm his/her email address.
2.2.4 - Multiple Memberships is not permitted, and each Member must maintain only one account. In case of duplication of Membership, only one Membership (the first Membership approved by us) will be maintained and all subsequent Memberships will be cancelled. Any Points accumulated in respect of the cancelled Memberships will be forfeited outright.
2.2.5 - All Registration Information provided during enrolment and throughout your interactions with Popcorn must be true and accurate. You must promptly update your Registration Information, as and when necessary to keep it true, accurate, current and complete. You are responsible for all activities related to your Popcorn Account and for maintaining the confidentiality of your username and password.
2.2.6 - Additionally, you must acknowledge receipt of these Terms and Conditions, and consent to our Privacy Policy to complete the enrolment process. Opting-in to our marketing communications (SMS) is not mandatory, however highly recommended, as this is the channel that we will use to keep our Members updated on offers, special events and rewards which might be of interest to them.
2.2.7 - Complete enrolment on the Popcorn App will allow the Member to access all features of the Program.
2.3 - Membership
2.3.1 - It is your responsibility to safeguard your Popcorn profile username and password details and ensure that it is not divulged to anyone. In the event of someone else using your username and password to make changes to your profile or transact on your behalf, we will not be held responsible for the changes and the outcome thereof.
2.4 Membership Account
2.4.1 - Applicants will be admitted to Membership on the date that they register via the Popcorn App. By registering, Members agree to be bound by these Terms and Conditions (as may be amended from time to time), the Privacy Policy and the information which may be posted on the Website and in the App.
2.4.2 - Each Member must give us immediate notice of any changes to their Registration Information such as name or preferred email or mobile contact details and if requested by us, written proof of any such changes. Members can at any time, update certain pieces of their personal information namely, their name, email address, phone number and residential location only, through the Popcorn App or by contacting the Popcorn customer support. The NIC and date of birth will purposefully not be editable after registration. This is to secure this key information that we might use to authenticate Members when calling our call center, for example, and to make sure we do not register members below 18 years old. If you made a mistake at registration and wish to change your NIC or date of birth, please send a copy of your NIC/RP to the contact inbox of the Program that you will find under Contact us on our website, and one of our customer service agents will be in touch to confirm the requested change.
2.4.3 - Correspondence will be sent to the Member's email address or mobile number (as applicable) provided on the Member's profile.
2.4.4 - We will not be responsible for late, lost or misdirected mails.
2.4.5 - Correspondence from Members should be sent to [email protected]
2.4.6 - We reserve the right to audit a Member's account and records without notice to the Member to check for compliance with these Terms and Conditions and any other applicable rules, regulations.
2.5 Termination of Membership
2.5.1 - Membership will terminate automatically:
- when a Member has not scanned any supermarket/shop ticket for 12 consecutive months; consequently, all accumulated Popcorn (Points) will expire and their Popcorn Account Deleted; or
- upon the death of the Member, Points accumulated but unused at the time of death shall be cancelled together with Membership to the Program; or
- if we reasonably believe that you have committed an act of Fraud or Misconduct against us or any Partner.
2.5.2 - Members may terminate their Membership at any time by initiating the account deletion process within the App. To do so, Members must navigate to their account settings, select "delete account," and confirm their selection by selecting "delete" again. Upon confirmation, Members will receive a message informing them that they will retain access to their account for 7 days, after which their account and all associated data, including accumulated Points, will be permanently deleted.
2.5.3 - In case of Fraud and/or Misconduct, we may cancel all accrued and accruing Points of the Member and any Rewards at the time of cancellation of the Membership.
2.6 Termination of the Program
2.6.1 - We may terminate the Program at any time at our sole discretion with no liability to you. If we do so, we will publish a notice on the Website and/or email you to let you know.
2.6.2 - If PNL ends the Program, Points accumulated but not used will expire on the date the Program ends. Accumulated but unredeemed Points shall be void after such date.
2.7 Changes to the Program
2.7.1 - PNL reserves the right, at its entire discretion, to update, change or replace any part of these Terms & Conditions at any time and without prior notice to Members, including but not limited to:
- end or cancel the Rewards;
- change any Reward or benefit we offer;
- change the requirements for earning Popcorn Points or a particular Reward;
- change the time you have in which to earn or redeem the Popcorn Points;
- change any other feature of the Program, including the Participating Brands; and/or
- Any upgrades or changes to better the offering of the App.
3. Points - Popcorns
3.1 - Earning Points here described as ‘Popcorns’
3.1.1 - As a benefit of being a Member, you can earn Popcorns and receive a cash back reward directly to your local bank account.
3.1.2 - Members shall only receive points through the purchase of those Brands which participate in the Program. Members can access to the list of brands on the App.
3.1.3 - Members can start earning popcorns (Points) immediately once registered through scanning of their supermarket or store receipts.
3.1.4 - The Popcorn Points will be recorded in the Member's personal account, and you can track your Points when logging into your account on the Popcorn App.
3.1.5 - Members can only earn Popcorns by:
- by scanning a valid supermarket receipt with Popcorn registered Brands on it (please refer to list of brands registered on Popcorn App);
- by scanning a QR code during a campaign or brand activation;
- by answering questions in a survey on the Popcorn App;
- By playing games on the App during specific campaigns; and
- By sponsoring new App downloads during Popcorn referral campaign.
3.1.6 - Popcorns are accumulated in your account each time you :
- scan your valid supermarket receipt with Popcorn registered brands on it. You earn 1 Popcorn for every Rs 50 spent on a Popcorn registered Brand;
- by scanning a QR code during a campaign or brand activation the number of Popcorns allocated will be communicated on the App;
- When answering questions in a survey on the Popcorn App the number of Popcorns (Points) allocated will be communicated on the App;
- When playing and winning the sponsored games on the App, 1 Popcorn Point will be allocated; and/or
- During a Popcorn referral campaign, the number of Popcorns allocated will be communicated on the App for each sponsoring.
3.1.7
A valid receipt from a supermarket refers to an official document provided by the store to you after completing a purchase therefrom. It serves as proof of transaction and contains specific details that verify the authenticity and legality of the sale. For a receipt to be considered valid, it typically includes the following elements:
- Supermarket Registration and Tax Information:
The receipt must clearly state the supermarket's/shop’s Business Registration Number with relevant authorities, such as the Mauritius Revenue Authority (MRA). This ensures the business is legally registered and operating within the country's tax framework. The tax identification number MRA registration number may be included on the receipt. - Store Name and Contact Information:
A valid receipt should include the supermarket's/shop’s name, physical address, and contact information such as a valid phone number or email address. This allows us to reach out for any inquiries or issues related to the transaction. - Date and Time of Purchase:
The receipt should show the date and time of the purchase, which helps establish when the transaction took place. This is essential for record-keeping purposes. - Itemized List of Purchased Goods:
All items bought should be clearly listed on the receipt, along with their quantities, descriptions, unit prices, and total cost. The items should be legible and easy to read, ensuring that customers can verify their purchases.
- Total Amount Paid:
The receipt must display the total amount paid for the items, including any applicable taxes. The breakdown of the tax amount (e.g., VAT or other local taxes) should be shown separately for transparency. - Payment Method:
The receipt should indicate the method of payment used, whether it’s cash, card, or another form of payment. This helps confirm that the transaction was completed successfully. - Return and Refund Policy: Often, a valid receipt will also outline the store’s policy on returns or exchanges, specifying the conditions under which a customer can return or exchange items.
In summary, a valid receipt from a supermarket/shop is a legal document that provides all necessary information about the transaction, including the store's registration, accurate item details, total price, and payment method. It ensures that both you and the App have a clear record of the purchase, which is essential for allocating Popcorns.
3.1.8 - Only receipts from supermarket’s/shop’s registered in Mauritius will be accepted. Other receipt from duty free shops or from another country will not be accepted.
3.1.9 - After scanning the supermarket’s/shop’s receipt and Popcorns allocated as per purchases, the receipt will be void and you won’t be able to scan the receipt again. Please note that the receipts are eligible for upload onto the App, within one (1) month of the date on which the purchase and issue of the receipt was made. Us
3.1.10 - Only whole Points will be allocated after the corresponding calculation of Points (An example would be: a Member who scans his receipt is eligible to earn Popcorns on registered Popcorn Brands as such should a Member have spent an amount of Rs 375 on Popcorn Brands, that Member will be allocated 7 Points, not 7,5Points).
3.1.11 - Points cannot be redeemed by Members until they have recorded on their account a minimum of 100 Popcorns’ Points which is equal to Rs 100. We endeavor to reflect any accrued Popcorns’ Points in your account within 4 business days of your upload of the receipt onto the App, but it may take up to 15 days in some cases. Any Points which are not converted into the cashback for any reason whatsoever, shall be restored into the Member’s Points balance on their account.
3.1.12 - Opportunities to earn extra Popcorns may be given at our sole discretion.
3.1.13 - We reserve the right to change, without prior notice, the number of Popcorns awarded for purchases at any time during the Program, at our entire discretion.
3.2 - Points Balance & Pending Points
3.2.1 - We will update your Popcorn Points balance each time you earn new Popcorns. We recommend that you monitor your Popcorns’ transactions on the App to ensure that your account is accurate and that the Brands were correctly identified on the receipt.
3.2.2 - PNL reserves the right to hold Popcorns relating to certain purchases in a pending status for up to 5 days these are “Flagged popcorns”
3.2.3 - We will determine in respect of which purchases we shall exercise our discretion to hold the Popcorns as provided under this section. If we hold Popcorns you will be able to see them in your Popcorn App account as ‘flagged’, but you will not be able to use them until we release them to your Popcorn account.
3.2.4 - We may deduct from the Points balance in a Member’s account any Points credited in error and any Points relating to a purchase which is cancelled or reversed or where a refund was made.
3.2.5 - In cases of dispute about entitlement to Points, we may require proof of a transaction. Claims in respect of Points must be lodged within 30 days of the purchase.
3.2.6 - Members will not be able to transfer Popcorns from one Member account to another.
3.3 - Points Expiry
3.3.1 - If a Member has not conducted any earn or redeem transactions as a loyalty Member within a consecutive period of 12 months, the account will be permanently and irreversibly deactivated and all Points that have accrued to that date will expire.
4. Points
4.1 - Redeeming Popcorns
4.1.1 - You will be able to redeem your Popcorns as soon as your account reaches 100 Popcorns.
Popcorns value: 1 Popcorn = 1 Mauritian Rupee
4.1.2 - A minimum of 100 Popcorns are required before redeeming them and there is a maximum of 500 Popcorns that can be redeemed at any one time.
4.1.3 - We reserve the right to change the conversion value of Points at our sole discretion and without prior notice. Members will be notified accordingly via email and on the App.
4.1.4 - Popcorns converted into Mauritian Rupees will be credited to your registered local bank account upon redeeming on the App, within 48 hours of you redeeming your Popcorns .
4.1.5 - To redeem your Popcorns you might be asked to complete your registration if this was not done at enrolment, and you may be asked to provide any other requested authentication information as applicable to ensure the Member’s account is safeguarded.
4.1.6 - The maximum amount of popcorns that a member will be allowed to redeem per day is 500 popcorns = Rs 500. The Member will receive a push notification on his/her mobile number confirming that the redeeming requested has been received.
5. System error/technical issues
5.1 - In any case, we reserve the right to reverse the Popcorn and deduct Popcorns from your account. Your Popcorn quantity will show a new balance.
5.2 - As the Program operates and relies on communication networks, electricity networks, etc. which are beyond our control, we cannot always ensure that the App operates at all times. However, we will make all reasonable efforts to ensure the good operation of the App.
5.3 - In the event of a technical error, system(s) or network failure, system upgrades at any time, Popcorn allocations, redemption, and/or other intervention that may affect the good running of the App, you will receive a push notifications to inform the Members of the downtime and as to when the App is expected to be back up and running.
6. Member Data
6.1 - Your Profile Information
6.1.1 - By becoming a Member of Popcorn, you agree to provide us with your Registration Information. Furthermore, you commit to regularly update and maintain your information to ensure its accuracy at all times.
6.1.2 - Any Registration Information you provide to us will be subject to our Privacy Policy, as amended from time to time.
6.2 - Your Account Activity
When you enroll into the Program, you authorize us to collect information about your activities as recorded in your Membership account (“Account Activity”), which may include the items you purchased, any amount that you redeemed, or any other information relating to your scanning or answers.
6.3 - Authorization for Popcorn to use your Information
You authorize us to use your registration information and account activity in accordance with the Popcorn Data Privacy Policy as amended from time to time, at our sole discretion.
- Using your Registration and activity Information for analysis
- Using your Registration Information and Account Activity to evaluate, develop, offer and promote our Brands to you; and
- Combining your Registration Information and Account Activity with that of other Members in order to create anonymised aggregated reports that we may share with our affiliates or non-affiliated third parties.
Please note that all reports which are extracted from the App shall have all the Registration Information anonymised.

6.5 - Push notifications and device identifier
We use third-party services (OneSignal and Firebase Cloud Messaging) to send you push notifications (e.g. rewards, offers). To do this, our app shares a device identifier (push token / subscription ID) with these providers. This identifier is used only to deliver notifications to your device and is not linked to your identity. We do not use Firebase Analytics or Firebase Crashlytics. 7. Limitation on Liability
PNL is not responsible for any liability due to unauthorized use and/or fraudulent actions on the Popcorn App. Except for cases of deliberate misconduct or gross negligence, PNL is not liable for any loss in relation to or due to not being able to use, not being able to use in time and/or not fully able to use the Popcorn App, for whatever reason. Besides, PNL is not liable for any loss arising from the use and the trust in the information about the benefits of the Popcorn App. In case of any alleged fraud or misuse, PNL has the right to forfeit the benefits of the Popcorn App and to terminate the Membership, as provided in section 2.5.1.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ANY OF PNL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND THEIR PROMOTION AGENCIES (“RELEASED PARTIES”) BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR MERCHANDISE OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF PNL IMPROPERLY DENIES A MEMBER ANY POINTS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT NUMBER OF POINTS. BY PARTICIPATING IN THE PROGRAM, A MEMBER WAIVES ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED.
BY PARTICIPATING IN THE PROGRAM, EACH MEMBER HEREBY RELEASES THE RELEASED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND OTHER EXPENSES (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) RELATING TO THAT MEMBER’S PARTICIPATION IN THE PROGRAM, USE OF POINTS OR REWARDS, OR AGREEMENT TO THESE PROGRAM TERMS AND CONDITIONS. PNL IS NOT RESPONSIBLE FOR REQUESTS OR CORRESPONDENCE LOST OR DELAYED IN THE MAIL.
PNL makes no warranties or representations, either expressed or implied, with respect to type, quality or fitness of goods or brands provided through the Program.
PNL will not be liable for any tax liability, duty or other charges in connection with the issuance of Popcorns and credited amounts on the local bank accounts of Members.
8. Severability
In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
9. Waiver
No decision of PNL to refrain from exercising or enforcing, or failure to exercise or enforce, its rights under any provision of these Terms and Conditions shall constitute a waiver thereof, or a waiver of the right of PNL to enforce any other provision of these Terms and Conditions, and no waiver by PNL of any violation of any provision or stipulation of these Terms and Conditions shall be deemed to be a waiver of any violation of any other provision or stipulation thereof.
10. Governing Law and Jurisdiction
10.1 - These Terms and Conditions shall be governed by the laws of Mauritius.
10.2 - You and PNL irrevocably agree that the courts in Mauritius shall have exclusive jurisdiction to settle any dispute or claim (whether contractual or non-contractual) arising out of or in connection with these Terms and Conditions, its subject matter or formation.
